  The Cabinet of Ministers of Ukraine (hereinafter – the CMU) has adopted and finally published the CMU Resolution “On Adoption of Technical Regulations on Energy Labelling” No 702 from 7 August 2013 (hereinafter – the CMU Resolution) that took into account the European Business Association proposals and provided new versions of the following technical regulations, namely: the “Technical Regulations on Energy Labelling of Household Electric Appliances”, the “Technical Regulations on Energy Labelling of Refrigerators, Freezers and their Combinations”, and the “Technical Regulations on Energy Labelling of Household Washing Machines” (hereinafter – the Technical Regulations). Background: The Technical Regulations were developed by the State Agency on Energy Efficiency and Energy Saving of Ukraine (hereinafter – the State Agency) in order to harmonise Ukrainian legislative requirements on the energy labelling of consumer electronics in accordance with updated EU legislation. At the same time the EBA Consumer Electronics Committee (hereinafter – the Committee) argued against the provision of the draft CMU Resolution that provided for public market surveillance on whether electronic equipment complies with the requirements of the Technical Regulations from the beginning of 2014. Representatives of industry were concerned that in such a short period of time it would be extremely difficult to develop and to produce energy labels. Thus, the Committee actively advocated the idea of prolonging the period of time from which the state authorities will check the equipment’s compliance, allowing market participants to prepare themselves for compliance with the Technical Regulations. As a result of the EBA’s efforts, the final version of the CMU Resolution has provisions, which state that the public market surveillance on whether electronic equipment complies with the requirements of the Technical Regulations, will start from 1 July 2014, instead of the previous provision that foresaw market surveillance from 1 January 2014.   We would like to thank all EBA members who supported and contributed to the EBA lobbying efforts and to the state authorities for constructive cooperation that led to this success. At the same time we will continue our activity aimed at clarifying, along with the State Agency, a guide on the application of the Technical Regulations that would satisfy our requirements.
