The draft Law “On Amendments to Certain Laws of Ukraine on Copyright and Related Rights Issues” from 12 December 2012 N 0902 (hereinafter – the draft law N 0902) was rejected and withdrawn from consideration of the Verkhovna Rada of Ukraine. On 2 April 2013 the Parliament adopted the Resolution “On Agenda of the Second Session of the Verkhovna Rada of Ukraine of the Seventh Convocation” N 2175 D that did not include the draft law N 0902.


Background: On 1 February 2011 the Verkhovna Rada of Ukraine adopted in the first reading a draft law “On Amendments to Certain Laws of Ukraine on Copyright and Related Rights Issues” from 15 June 2010 N 6523 (hereinafter – the draft law N 6523). The EBA Consumer Electronics Committee lobbied against some provisions of the above law, namely, amendments to the Law of Ukraine “On Copyright and Related Rights” from 23 December 1993 N 3792-XII. First of all, the Committee was against provisions on obtainment of special certificates before the customs clearance of goods, such as the above provision, which would lead to creation of additional non-tariff barriers to international trade and would result in significant delays in supplying consumer electronics into the Ukrainian market.


Thus EBA Consumer Electronics Committee since 2011 actively advocated the idea of revision of the draft law N 6523. The EBA organized a number of meetings with representatives of different state authorities, elaborated a huge amount of letters and promoted the Committee’s position on all possible levels. Due to our efforts the draft law N 6523 was not submitted for the second reading in the Verkhovna Rada of the Sixth Convocation and on the 2 April 2013 was rejected and withdrawn from the agenda of the Verkhovna Rada of the Seventh Convocation (the draft law N 6523 was reregistered as the draft law N 0902 on 12 December 2012).


We would like to thank all EBA members who supported our lobbying efforts focused on solving this issue. The EBA will continue monitoring elaboration of new legislation on copyright issues in order to advocate the legitimate interests of our members and to ensure creation of an efficient system of copyright protection in Ukraine.
