May 26, 2008. SAYENKO KHARENKO acted as a Ukrainian legal counsel to Berger Paints India Limited ("Berger") on merger clearance in Ukraine to acquire Bolix S.A. ("Bolix"), a Polish building materials production company.

The concentration was carried out through the acquisition of control over Bolix by Berger.

The Berger groups of companies are active in the field of manufacturing and selling of decorative paints, automotive and general industrial paints, protective coatings and powder coatings. The main activity of Bolix is production of building materials.

As the result of the concentration, the Berger Group will be able to expand its activities into new geographical and product markets.

After reviewing the transaction, the AMC concluded that the proposed concentration will not lead to monopolization or significant limitation of competition in Ukraine and cleared the transaction within a significantly short period of time.
